भाषा: यह हिंदी अनुवाद सुविधा के लिए दिया गया है। जापानी शर्तों से विरोध होने पर, लागू कानून और न्यायालय (जापान; Yokohama District Court, Hiratsuka Branch, अनिवार्य consumer law के अधीन) के लिए जापानी पाठ प्रभावी होगा।
ArcheryNow (“ऐप”) का उपयोग करके आप इन शर्तों से सहमत होते हैं। गोपनीयता नीति data handling समझाती है। कार्यान्वयन के अनुरूप ये शर्तें सामान्य जानकारी हैं, कानूनी सलाह नहीं।
1. Service scope
ऐप local-first archery scorekeeping, statistics, visualization, export और practice reference सुविधाएँ देता है। Eligible Accounts को hosted Club, Team, invitation, sharing, coach, private-media और Selection Event सुविधाएँ भी मिल सकती हैं। Feature availability platform, environment, cohort, role, resource authorization, plan, quota और operational policy पर निर्भर हो सकती है।
Applicable law के अधीन, हम ऐप के सभी या कुछ हिस्से बदल, suspend या discontinue कर सकते हैं। Experimental या Beta features अधूरे, capacity-limited या withdrawn हो सकते हैं।
2. व्यक्तिगत उपयोग और Accounts
मुख्य व्यक्तिगत scorekeeping के लिए hosted Club Account आवश्यक नहीं है। Hosted Club सुविधाओं के लिए यह जरूरी है। आपको setup की सही जानकारी देनी होगी, केवल अपना approved sign-in method उपयोग करना होगा, device और session सुरक्षित रखना होगा, और suspected unauthorized access पर तुरंत sign out या report करना होगा।
Club Accounts Supabase Auth के साथ Apple या Google sign-in उपयोग कर सकते हैं। Account setup में सभी के लिए 18 वर्ष या अधिक होने की पुष्टि आवश्यक नहीं है। यदि लागू कानून किसी विशेष user, region या feature के लिए parent/guardian authorization, minimum age या अन्य safeguard मांगता है, तो वह requirement लागू होगा और पूरा होने तक access सीमित किया जा सकता है। किसी अन्य व्यक्ति के लिए Account न बनाएँ और लागू age/guardian requirement को bypass न करें।
3. Clubs, roles, invitations और sharing
Club tenant, authorization और commercial boundary है; Team, Club के भीतर group है। Owners, administrators, coaches, billing managers और members की permissions अलग होती हैं। Commercial entitlement कभी role और resource authorization का स्थान नहीं लेता।
आप invitation केवल legitimate Club purpose और intended recipient के लिए issue या accept कर सकते हैं। Private invitation credentials publish न करें और किसी अन्य व्यक्ति का credential उपयोग न करें। Club join करने से historical personal records share नहीं होते। Record तभी share होता है जब owner स्पष्ट रूप से उसे और audience चुनता है। सीमित audit, integrity, safety और legal retention के अधीन owner publication revoke कर सकता है।
Owners और authorized managers membership, roles, Teams, event access, retention choices तथा Club data के lawful use के लिए जिम्मेदार हैं। Club deletion में अभी cleanup से पहले सात-दिन की scheduled recovery window है।
4. User content और acceptable conduct
“User content” में Club/Team/display names, avatars और icons, structured shared score records, Selection Event submissions और आपकी दी अन्य जानकारी शामिल है। आप अपने content के rights रखते हैं और हमें केवल ऐप operate, secure, moderate, back up, export और improve करने, कानून का पालन करने तथा ये शर्तें लागू करने के लिए इसे host, copy, transform, display और process करने का सीमित, non-exclusive license देते हैं।
आपको निम्न कार्य नहीं करने चाहिए:
- कानून, public order, privacy, intellectual-property या अन्य rights का उल्लंघन;
- किसी को harass या threaten करना, hate या abuse बढ़ावा देना, impersonate या exploit करना, या किसी व्यक्ति को expose करना;
- sexual content, violent threats, fraud, spam, malware या deceptive records submit करना;
- उचित आधार के बिना किसी अन्य व्यक्ति का score, image, identifier या private information share करना;
- Selection Event evidence manipulate करना, organizer/reviewer का impersonation करना, या result को गलत तरीके से official बताना;
- roles, quotas, blocks, feature flags, security controls या restricted state bypass करना;
- ऐप या hosted service को probe, disrupt, overload करना या unauthorized access पाना; या
- अनुमति के बिना ऐप या Club data resell या commercially exploit करना।
5. Reports, blocks और moderation
ऐप fixed-category reporting और Account blocking दे सकता है। Reports good faith में किए जाने चाहिए। Safety, security, legal compliance या enforcement के लिए उचित रूप से जरूरी होने पर हम safety evidence review, preserve और investigate कर सकते हैं; content, invitations, sharing, visibility या access restrict कर सकते हैं; corrective action मांग सकते हैं; या Account अथवा Club suspend/terminate कर सकते हैं। हम किसी खास outcome या response time का वादा नहीं करते।
Blocking Accounts के बीच supported interactions सीमित करता है, लेकिन यह guarantee नहीं कर सकता कि लोग ऐप के बाहर या किसी अन्य Account/Club के जरिए कभी एक-दूसरे से नहीं मिलेंगे। तत्काल खतरे की सूचना उचित local emergency या law-enforcement services को दें, public GitHub Issue को नहीं।
6. Selection Events
Selection Events structured Club tools हैं; ArcheryNow या किसी governing federation का certification नहीं। Organizers eligibility, rules, reviewer assignments, deadlines, retention और communication के लिए जिम्मेदार हैं। Participants सही और authorized records submit करने के लिए जिम्मेदार हैं। App calculations, reviews, leaderboards और decision rows में errors हो सकते हैं और उन्हें safety-critical, employment, medical या legally significant decisions का एकमात्र आधार नहीं बनाया जाना चाहिए।
7. मुफ़्त Club Beta (v1.5.0)
v1.5.0 Club feature eligible authenticated Accounts के लिए मुफ़्त और समयबद्ध Beta के रूप में दिया जाता है। Server-issued Pilot grant प्रत्येक Account को अधिकतम एक Pilot Club देता है और member, coach, Team या अन्य limits लागू करता है; roster, Team, Event, limited Leaderboard, basic coach-review और audit functions शामिल हो सकते हैं। Eligibility server contract तय करता है, केवल version 1.5.0 install या retain करना नहीं।
- Pilot घोषित अवधि के लिए free है।
- Pilot join करने से paid Club subscription नहीं बनता, Club payment collect नहीं होता, paid में convert होने वाला trial शुरू नहीं होता और अंत में automatic billing authorize नहीं होती।
- Pilot dates, limits और availability safety, capacity, release readiness तथा notice requirements के आधार पर extend, reduce, pause या end हो सकती हैं।
- बाद की paid offering स्पष्ट रूप से purchase न करने वाला Club delete होने के बजाय
restrictedहो सकता है। New creation, expansion, advanced administration, analytics या Event mutations रुक सकती हैं, जबकि authorized reads और export, unsharing, leaving, ownership transfer, purchase restore तथा Account deletion जैसे safety operations security और resource authorization के अधीन उपलब्ध रखने का इरादा है। - केवल limit या Pilot period समाप्त होने से over-limit data अपने-आप delete नहीं होता; इसके बजाय expansion block हो सकता है।
8. Personal Pro और future paid Club plans
Personal Pro, Club access से अलग है। Personal Pro purchases संबंधित App Store का उपयोग करती हैं और personal entitlements तय करने के लिए RevenueCat का उपयोग कर सकती हैं। Personal Pro purchase Club plan बनाती, उसका payment करती या उसकी guarantee नहीं देती।
Beta के बाद कोई paid Club offering तभी शुरू होगी जब price, period, renewal और plan terms संबंधित store या provider द्वारा दिखाए जाने के बाद Club owner या authorized billing manager अलग से स्पष्ट purchase करे। RevenueCat केवल purchase path सक्षम होने के बाद later paid Club entitlement boundary के लिए उपयोग हो सकता है। केवल Beta participation कभी RevenueCat, Apple या किसी अन्य provider को Club charge शुरू करने की अनुमति नहीं देती।
Enabled purchase पर prices, taxes, renewal, cancellation और refunds store display तथा applicable store terms के अनुसार होंगे। Apple purchases Apple Media Services Terms के अधीन हैं; subscriptions store से manage करें और जहाँ लागू हो Report a Problem के जरिए refund माँगें।
9. Coach और AI information
Coach, statistics और AI outputs recorded data पर आधारित reference information हैं। वे medical advice, diagnosis, treatment, guaranteed performance guidance या certified coach का substitute नहीं हैं। Supported devices पर कुछ AI processing platform terms के तहत on-device हो सकती है।
10. Intellectual property
ऐप, software, designs और documentation हमारे या licensors के हैं। कानून या applicable open-source license से अनुमत सीमा के अलावा protected materials को copy, reverse engineer, distribute या उनसे derivative services नहीं बना सकते। संबंधित content delete होने पर आपका limited user-content license समाप्त होता है, सिवाय Privacy Policy में बताए retained safety, audit, backup, integrity और legal records के।
11. Suspension, termination और deletion
आप ऐप उपयोग करना बंद कर सकते हैं, Club छोड़ सकते हैं, supported shares revoke कर सकते हैं और उपलब्ध controls से Account deletion request कर सकते हैं। Deletion से पहले ownership, billing-management, active-event या integrity blockers हल करने पड़ सकते हैं। Local/iCloud/Google Drive data अलग है और आपके control में रहता है।
Violations, threats, fraud, security incidents, legal requirements या operational risk के लिए हम access restrict या suspend कर सकते हैं। Paid या Pilot entitlement बिना misconduct के समाप्त हो तो safety operations ऊपर बताए अनुसार बनाए रखने का हमारा इरादा है; इससे unsafe content बनाए रखने या role, block अथवा resource authorization से प्रतिबंधित access देने का दायित्व नहीं बनता।
12. Disclaimers और liability
ऐप “जैसा है” और “उपलब्धता के अनुसार” दिया जाता है। कानून द्वारा अनुमत सीमा तक हम uninterrupted availability, error-free calculations, हर record के preservation, particular purpose के लिए fitness या Club, organizer अथवा federation द्वारा App data acceptance की guarantee नहीं देते। ये शर्तें उस liability को exclude नहीं करतीं जिसे कानूनन exclude नहीं किया जा सकता, जिसमें जहाँ लागू हो willful misconduct या gross negligence की liability शामिल है। Mandatory consumer rights अप्रभावित रहते हैं।
13. लागू कानून और न्यायालय
इन शर्तों पर Japan के कानून लागू होते हैं। अनिवार्य consumer law से किसी अन्य competent court की अनुमति होने को छोड़कर, first instance का agreed exclusive court Yokohama District Court, Hiratsuka Branch है।
14. परिवर्तन
हम ये शर्तें update कर सकते हैं। Effective date और document version ऊपर हैं। Material changes की उचित सूचना ऐप, invitation notice, store notes या kitokito.app पर ArcheryNow की कानूनी साइट के जरिए देने का प्रयास करेंगे। जहाँ applicable law अलग consent माँगता है, केवल continued use उसका स्थान नहीं लेगा।
15. संपर्क
कोई public support या moderation email address नहीं है। GitHub Issues या संबंधित App Store developer support route उपयोग करें। Public Issue में credentials, private invitations या sensitive Club content पोस्ट न करें।
